These Terms of Service ("Terms") govern your use of the Buena AI, Inc. website and services ("we," "us," or "our"). By using our Website and services, you agree to these Terms.

Description of Buena AI

Buena AI, Inc., a Delaware-based corporation, empowers individuals ranging from startups, founders, and strategic account teams into leveraging the most advanced AI agents for powering outbound outreach. The Buena platform handles the complexities of sales development, saving you hundreds of hours from prospecting, qualifying, conducting strategic research, personalizing, and engaging your target market. With Buena, you are automatically provided with a fleet of multiple agents operating every minute of the day, aiding your Go-to-Market efforts.

We currently provide easy integration into your existing email infrastructure and offer best-in-class domain reputation management. We also allow you to scale and expand your outreach infrastructure as needed. Our platform supports a multi-channel outreach strategy that integrates natively with social selling.

When it comes to prospecting, we offer three Prospecting Engines that you can easily switch to tailor your outbound approach. Our systems automatically prevent bounced emails, working around the clock to verify and identify the correct email addresses of your target market. With native Zoom, Google Calendar, and LinkedIn integrations, your agents can interact naturally with prospects and book meetings, allowing your team to focus on closing more deals.

We are constantly improving and updating our services, including adding video prospecting and strategic/enterprise accounts features from beta to full rollout. We are also working on creating a full-autopilot feature to further enhance your sales efforts.

LinkedIn Integration

Our LinkedIn integration is designed to help users prospect, send meaningful connections, and messages. We only use credentials which you have agreed to or given permission for, with the sole purpose of helping you prospect and create more demos.

Ownership and Usage Rights

You own the leads, contacts, connections, and sales you create using Buena AI. However, Buena AI retains ownership of the software and services provided. Any demo, trial, or usage of the Buena AI platform is considered intellectual property of Buena AI and is provided for evaluation purposes only. It is not licensed for distribution, sublicensing, or use in any manner not explicitly authorized by Buena AI in writing. Unauthorized distribution, sharing, or disclosure of the platform, its code, or its functionality to competitors or third parties is strictly prohibited.

Prohibited Uses

You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, or underlying structure of the Buena AI platform. Sharing or using the platform with any competitor of Buena AI is strictly prohibited. Any violation of this clause may result in immediate termination of your access to the platform, legal action, and liability for damages.

User Data and Privacy

Integrations and Data Usage

We want to emphasize that we will only use the integration(s) you explicitly choose to connect with from the app.buena.ai/dashboard/integrations page. These integrations are used solely for the purpose of helping you increase your prospecting and demo rates. We do not access or use any data from integrations you have not explicitly authorized.

Security Measures

We take your data security seriously. We use industry-standard encryption methods, including:

• Standard level encryption of JWKs (JSON Web Key Sets)
• Data encryption in-transit with TLS 1.2
• Continuous monitoring and updating of our security protocols

These measures are in place to ensure the confidentiality and integrity of your data throughout its lifecycle in our system.

Cookies and Tracking

We use cookies and other tracking technologies to enhance your experience and improve our services.

Pilot Beta Trials

Pilot Beta Trials are for a duration of 30-60 days at most and will be increased and provided with more features as we develop our platform.

Indemnification

You agree to indemnify, defend, and hold harmless Buena AI, Inc., its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the service using your account.

Logo Rights

By using our services, you grant Buena AI, Inc. the right to use your company name and logo for marketing and promotional purposes, including but not limited to featuring it on our website, marketing materials, and social media channels. Governing Law

These Terms are governed by the laws of the United States.
